1. Who we are and what these terms cover
Panko: Pomodoro & Focus ("Panko", "the App") is provided by QubitumAI SAS, SIREN 942469610, registered-office SIRET 94246961000011, 60 rue Notre-Dame de Nazareth, 75003 Paris, France ("we", "us"). Panko is intended for adults aged 18 and over. By downloading or using the App you agree to these Terms. If you obtained the App through Apple's App Store, Apple's Licensed Application End User License Agreement also applies; where it conflicts with these Terms, Apple's EULA prevails for App Store users. Mandatory consumer rights remain unaffected.
2. License
We grant you a personal, non-exclusive, non-transferable, revocable license to use the App on devices you own or control, in accordance with the rules of the store you downloaded it from. You may not copy, modify, reverse-engineer, resell or redistribute the App or its artwork, characters and sounds.
3. The free tier
The complete timer, Panko, the starter recipes, the shop and your regular customers are free. The free tier may show non-personalized banner ads on the Shop and Recipe Book screens, and optional rewarded ads outside active focus sessions and breaks. We may adjust the free tier over time, but recipes are earned through focus time, not bought. The optional next-step note also works without Pro or a Panko account.
4. Panko Pro ("Pâtissier") — subscriptions and lifetime purchase
While the Pro entitlement is active, Panko Pro prevents advertising requests and unlocks premium ambiences, extended statistics and CSV export, and the Pro decorations and baker options identified in the App. Available purchase options are displayed before checkout and may include:
- Monthly subscription — billed every month, renews automatically until cancelled.
- Annual subscription — billed every year, renews automatically until cancelled.
- Lifetime — a single one-time payment, no renewal, valid for the lifetime of the App on your store account.
- Lifetime Family — where offered on iOS, a one-time purchase shared through Apple Family Sharing as described before purchase. This offer is not available on Android: Google Play Family Library does not share in-app purchases.
Prices and billing periods are shown in your local currency before purchase, and payment is handled by your Apple or Google store account. Subscriptions renew automatically until cancelled under the store's terms. Manage renewal before the next billing date in your store account: iOS Settings → your name → Subscriptions, or Android Play Store → Payments & subscriptions. Cancellation stops future renewal; access normally continues until the paid period expires unless the store revokes or refunds the purchase. Deleting the App or erasing local data does not cancel a subscription. After Pro expires or is revoked, the free tier and its advertising rules apply.
5. Refunds and restoring purchases
Purchases are processed by Apple or Google; refunds follow their policies and are requested through them. You can restore previous purchases at any time with the Restore purchases button in the App or in Settings.
6. Your data
Panko stores sessions, progress and the optional next-step note in the App without sending their content to us. Device backups and user-exported files may retain copies. Local erasure retains your chosen language and purchase entitlements and does not delete provider records. See our Privacy Policy for details and privacy requests.
7. Acceptable use
Do not use the App for unlawful purposes, attempt to bypass purchases or advertising, or interfere with the App's operation.
8. Health notice
Panko is a timer and a companion. It is not a medical or therapeutic product and makes no health claims. Take breaks that suit you.
9. Availability, changes and termination
We may update features or discontinue the service, subject to applicable consumer rights and any required notice or remedy. A lifetime purchase means a one-time entitlement for the lifetime of the App, not a promise that the service or every future feature will exist indefinitely. Material changes to purchased benefits remain subject to applicable law.
10. Warranty and liability
The App is provided "as is". To the extent permitted by law, we exclude implied warranties and limit our liability to the amount you paid for the App in the twelve months before the claim. Nothing in these Terms limits rights you have as a consumer under mandatory law.
11. Governing law
These Terms are governed by French law. Consumers in the EU keep the protection of the mandatory rules of their country of residence and may bring claims before a competent court as provided by applicable law. For a complaint, first contact contact@qubitumai.com. Nothing in these Terms prevents you from using an available statutory consumer-redress procedure.
